General Terms and Conditions

  1. Introduction

These General Terms and Conditions (GTC) define the framework of the contractual relationship between Villa Estelle (hereinafter: Service Provider) and the guest (hereinafter: Guest). The Guesthouse is located at 8172 Balatonakarattya, Mogyoró Street 7/B.

The operator of the Service Provider is HULS Consulting Ltd., with its registered office at 1037 Budapest, Citromfű Street 11/A, registered by the Budapest Tribunal Company Registry, Tax ID: 26145369-2-41, Guesthouse name: Villa Estelle, Address: 8172 Balatonakarattya, Mogyoró Street 7/B, NTAK: EG24099166, Website: www.villaestelle.hu, Email: office@villaestelle.hu, Phone: +36 30 907 40 50, Language of the contract: Hungarian.

Basic Provisions

Hungarian law applies to questions not regulated by these GTC, particularly the 2013 Act V of the Civil Code (“Ptk.”), the 2001 Act CVIII on electronic commerce services and certain issues related to information society services, the detailed rules on the indication of sales prices and unit prices of products, as well as the fees for services as per the joint regulation 4/2009 (I. 30.) NFGM-SZMM, and the 239/2009 (X. 20.) Government decree on the detailed conditions of accommodation service activities and the issuance of accommodation operation permits.

The mandatory provisions of relevant laws apply to the parties without any special stipulation.

These GTC apply to all bookings made on the websites operated by the Service Provider. The Service Provider may modify these GTC at any time.

In the event of any modification of these GTC, the Service Provider is obliged to publish the modified GTC, consolidated, on its website at least 30 days before it takes effect, alongside the current GTC. The Service Provider will also publish previous versions of the GTC on its website.

The Service Provider draws attention to the fact that all elements of the website used for accommodation services are protected by copyright as a work of authorship. The website will be continuously available without interruption, except for technical outages. By accepting the GTC, the House Rules are also accepted.

 

  1. Use of Service

No registration is required to book accommodation offered on the website. By making a purchase on the website, the user declares that they have read and accepted the terms of these GTC, the House Rules published on the website, and the Data Management Notice, and consents to the data processing.

The booking includes the Guest’s name, address, phone number, email address, and exact arrival and departure times. The Guest is obliged to verify the accuracy of the data provided on the website/accommodation intermediary interface before finalizing the booking. The Service Provider is not liable for any delays or other issues arising from inaccurate or incorrectly provided data by the User.

The displayed product (booking accommodation) can only be ordered online. The prices displayed for products are in HUF, including the legally required VAT, but do not include the local tourist tax. The Service Provider provides detailed information about the product name, description, and a photo on the website. Images displayed on the product page may differ from reality and serve as illustrations. If a promotional price is introduced, the Service Provider will fully inform Users about the promotion and its exact duration. If, despite the Service Provider’s best efforts, an incorrect price appears on the website—especially if it significantly deviates from the product’s known or commonly accepted price due to an error or system malfunction (e.g., a price of “0” HUF or “1” HUF)—the Service Provider is not obligated to sell the product at that erroneous price and may offer the correct price instead, with the Client having the option to withdraw from the purchase. A significant deviation is considered a change of at least 50% in either direction from the market value of the product or service. Due to apparent disparities, a confirmed order at an incorrect/wrong price will be considered null and void.

 

Conditions for Using the Service:

  • Presentation of personal documents for every guest.
  • Payment of the total amount for services.

The guesthouse is only available as a whole for families or groups of friends. The maximum capacity is 8+4 people. The guests, as contracting parties, use the guesthouse located at 8172 Balatonakarattya, Mogyoró Street 7/B, which has 4 bedrooms, 4 bathrooms, a fully equipped kitchen, a living-dining area, a landscaped garden, furniture, garden furniture, parking, a pool, a sauna, and a jacuzzi, for other accommodation, holiday, or relaxation purposes. The furnishings and equipment located in the house and the garden, including careful use of the garden grill and cooking area, are made available to you during your stay. The Service Provider cannot be held responsible for personal belongings in the house, parking, or storage, as well as for personal injuries resulting from improper use of the house and its surroundings or damages incurred within the house. Guests are jointly liable for damages caused by themselves and their invitees within the house and its furnishings.

 

  1. Booking

Booking can be done via the Service Provider’s website, accommodation intermediary sites, by phone, or by email. To confirm the booking, the Guest must pay the full value of the booking to the Service Provider, which will be confirmed by the Service Provider via email. If there is no response to the email offer, the quote will be deleted after a 2-day grace period.

The booking becomes valid after payment of 50% of the total accommodation cost, which also signifies automatic acceptance of the House Rules, Booking, and Cancellation Terms, and the GTC.

The Service Provider may change the advertised prices of the guesthouse freely until the participation fee is paid without prior notice.

The guesthouse can be occupied on the day of arrival from 15:00 (check-in) and must be vacated by 10:00 on the day of departure (check-out). In case of late departure, the Service Provider has the right to charge an extra fee.

The booking process occurs through the booking menu on the website, accommodation intermediary sites, via email, or by phone.

 

Booking Confirmation

The Service Provider confirms every booking via email.

The Service Provider is obliged to promptly confirm the receipt of the Guest’s booking electronically. If the confirmation does not arrive within the expected time frame, depending on the nature of the service but no later than 48 hours after the Guest’s submission, the Guest is released from any offer commitment or contractual obligation. The booking and its confirmation are considered received by the Service Provider or the Guest when they become accessible to them.

 

Booking Prices

The prices issued by the Service Provider include VAT but do not include the tourist tax defined by law that is applicable at the time of booking. The prices do not include travel costs to and from the guesthouse. If a promotional price is introduced, the Service Provider will inform Guests about the duration of the promotion on the website.

The accommodation fee or 50% of it must be paid in advance at the time of booking, with the remaining amount to be paid by the 7th day before arrival. The payment for the booked service can be made in advance via bank transfer or using the PayPal/SimplePay online payment service through the link available on the website at the time of booking.

The Service Provider is liable for damages caused to the Guest. The Guest is liable for damages caused by themselves to the Service Provider in the Guesthouse or its furnishings.

 

  1. Cancellation and Modification

Cancellation of Booking

The Guest is obliged to inform the Service Provider in writing of any potential cancellation, modification, or other changes to their booking before the start of the service.

 

Cancellation Fees

Bookings can be canceled free of charge 30 days before arrival.

For cancellations between 30-15 days before arrival, the cancellation fee is 50% of the ordered services.

For cancellations within 15 days of arrival, the cancellation fee is 100% of the ordered services. The Guest declares that they consider the cancellation fees proportional and accepts them; otherwise, they cannot finalize their booking.

Bookings are considered valid only in the case of a successful transaction.

The Service Provider reserves the right to cancel the fulfillment of the booking made and confirmed by the Guest no later than 15 days before the commencement of service, with a written notice and simultaneous refund of the booking fee paid by the Guest.

If the Guest does not arrive on the indicated day and no cancellation has been made, the Guesthouse may be rented out by the Operator for the remaining period of the order.

 

Online Payment System

The Service Provider stores data that it has acquired during the ordering process, meaning that it may only use the cardholder’s name for the execution of transactions authorized by the cardholder. The Service Provider does not possess any other data generated during the transaction. The Service Provider is not liable for damages resulting from the use of the cardholder’s password by a third party due to the Guest’s negligence. The Guest declares that they will not seek reimbursement for the value of the ordered and completed services. The Service Provider does not bear any responsibility for damages arising from incorrect data entry or typographical errors made by the Guest. The Service Provider is not liable for damages caused by the provision of incorrect data and will investigate reported complaints promptly and handle them as appropriate.

 

  1. Complaint Handling

The Service Provider conducts complaint management at its headquarters located at 1037 Budapest, Citromfű Street 11/A. The Service Provider requests that Guests label complaints with “COMPLAINT” to expedite the process and include their contact information. The Guest is obliged to fully present the circumstances related to their complaint for the evaluation of its validity. In the event of a dispute between the parties, the Service Provider will strive to resolve it in a mutually satisfactory manner. The Guest may submit a written complaint to the Service Provider regarding the conduct, activities, or omissions of the Service Provider or persons acting on its behalf in relation to the provision of services to the Guest.

The Service Provider is obliged to record the complaint and its position on it immediately and to send a copy of the record to the Guest no later than simultaneously with the substantive response. The complaint must be assigned a unique identification number.

The record of the complaint must include the following:

  • The Guest’s name and address,
  • The place, time, and method of submitting the complaint,
  • A detailed description of the Guest’s complaint, including a list of documents and other evidence presented by the Guest,
  • The Service Provider’s statement regarding the Guest’s complaint,
  • The signature of the person taking the record,
  • The place and time of taking the record,
  • The unique identification number of the complaint.

The Service Provider is obliged to respond in writing to the submitted complaint within thirty days of its receipt and to take steps to communicate this. A shorter deadline may be established by law, while a longer deadline may be set by statute. The Service Provider is obliged to justify its refusal of the complaint.

Data Transmission Statement

The data may be transmitted to external invoicing software, the NTAK system, or cloud systems. The Guest declares that they are familiar with the provisions outlined in the General Terms and Conditions and that they acknowledge them.

 

  1. Payment Terms

Payment of 50% of the total amount for the ordered services is required at the time of booking, either by credit card or in advance via bank transfer. The Service Provider reserves the right to modify the prices of services according to the prices valid at the time of booking.

 

  1. Usage Rules

The Guest is obliged to comply with the House Rules of the Guesthouse, which include regulations on noise restrictions, use of common areas, and the use of the pool/jacuzzi/sauna.

 

  1. Liability

The Service Provider is not responsible for damages caused by the Guest on the premises of the Guesthouse. The Guest is required to pay for damages incurred due to their negligent behavior.

 

Data Management Rules

The data protection notice and data protection policy of the hosting service provider can be found alongside the General Terms and Conditions.

 

  1. Legal Remedies

The parties primarily aim to resolve any disputes through negotiation.

 

  1. Final Provisions

These General Terms and Conditions are valid from the date specified by the Service Provider, and by finalizing the booking, the Guest acknowledges and accepts them.
